About this guide

Virginia sends a challenge to the immediate DUI administrative suspension to the court where the charge arose. That review has a specific probable-cause focus and does not decide the entire DUI or refusal case.

Read the immediate suspension notice first

Virginia's immediate suspension procedure is established by section 46.2-391.2. It applies when the statutory test-result or refusal conditions and required charge are present. The officer personally serves the suspension notice and takes possession of a Virginia-issued license. A nonresident or an unlicensed person can instead lose the privilege to drive in Virginia. The absence of a Virginia plastic card does not prevent the state from imposing the administrative action.

Record the service time, arrest location, charged offense, and alleged prior-offense category. The ordinary first-offense suspension lasts seven days. A second-offense charge generally carries 60 days, ending at trial if earlier except during the first seven days; a third or subsequent charge continues until trial. Preserve the notice, summons or warrant, and available test paperwork together. An older suspension from another event can remain effective even if the new administrative period later ends.

Review is requested in the general district court for the jurisdiction of arrest, or the appropriate court with juvenile jurisdiction. The statute allows the request during the suspension period and gives it expedited treatment. It does not establish a generic DMV hearing request deadline borrowed from another state. Contact the proper court promptly for its filing and scheduling procedure because a short suspension can run before a delayed inquiry produces a useful hearing date.

Understand what the court can decide

The administrative review examines probable cause for the arrest, warrant, or petition and, where relevant, the basis for charging a repeat offense. The person seeking relief has the statutory burden of proving the defect by a preponderance of the evidence. This is a narrower inquiry than deciding guilt at the eventual trial. Organize the evidence around the precise probable-cause issue rather than treating the review as an opportunity to resolve every factual dispute in the criminal case.

If the court finds the required defect, it can rescind the suspension or reduce the part exceeding the properly supported offense level. Otherwise it affirms the suspension. The court's findings are without prejudice in other civil or criminal proceedings and are not evidence in those proceedings under the statute. Missing the review without just cause waives the right to that review. Confirm attendance arrangements and retain proof of any authorized change to the hearing date.

The eventual DUI conviction has a separate licensing framework under section 18.2-271, and the criminal punishment is governed by section 18.2-270. Success at the administrative review therefore does not dismiss the DUI charge or decide its sentence. Continue following every trial notice and court condition after an administrative suspension is rescinded, including any separate release or supervision requirements.

When organizing the review packet, distinguish an offense date from the date of conviction for any alleged prior case. Include the available official disposition rather than relying on a background-check abbreviation. The court must evaluate the statutory basis for the charged level, and a clear chronology helps identify whether the disputed fact concerns the immediate suspension or a different proceeding.

Keep refusal litigation distinct

An unreasonable refusal allegation follows Virginia's refusal procedures. First breath refusal is civil, and qualifying repeat breath refusal can be criminal; blood refusal is separately addressed as civil. The officer's advisement and certification are part of that statutory procedure. A refusal finding can carry a one-year suspension or a qualifying three-year revocation in addition to the immediate administrative action. Identify which test and which subsection are charged before evaluating the notice.

An administrative probable-cause review does not substitute for contesting the refusal charge itself. A driver may have separate issues concerning the arrest, the refusal advisement, the alleged refusal, or the prior history. Present each through the proceeding that has authority to decide it. Do not assume that resolving one charge cancels all other notices, particularly when the record also includes an earlier DUI revocation or an out-of-state licensing action.

Consider the specific 2026 restricted route

As reviewed October 21, 2026, section 46.2-391.2 now allows a person administratively suspended after a second-offense charge to petition the general district court where the charge occurred for a restricted license and ignition interlock. The law requires the relevant alcohol safety program prequalification and court conditions. This route addresses limited driving authority during the pending case; it differs from a claim that the suspension lacked probable cause. Request the remedy that fits the driver's actual objective and circumstances.

Interlock arrangements are governed by section 18.2-270.1, while section 18.2-271.1 covers certified program participation and restricted permits. Current law can credit qualifying pretrial installation time toward later ordered periods. The credit provision does not itself authorize driving. Obtain the actual order, identify when it becomes effective, and confirm all requirements before operating an interlock-equipped vehicle.

Contact VASAP for the authorized enrollment and installation process. A consumer purchase of a device outside the program does not establish court compliance. Keep installation, monitoring, enrollment, and order records together because different organizations report different parts of the process. If an order supplies temporary restricted authority pending DMV issuance, complete the DMV transaction before that authority expires and carry the documents the order requires.

Follow the clerk's disposition and DMV record

When administrative suspension ends or is rescinded, the clerk handles return of the surrendered Virginia license under the statute. The driver may elect collection or mailing through the provided process. Returning the card is distinct from verifying the absence of another active suspension. Obtain a current driving transcript if the full status is uncertain, and compare it with the court's written rescission, reduction, or restricted-license order.

DMV's reinstatement guidance recommends a compliance summary and personal transcript when working through outstanding licensing requirements. The summary is a list of current requirements, not the official transcript itself. If the court's disposition has not appeared, contact the clerk about transmission and DMV about the posted record. Retain the entered order; an informal statement that the hearing went well does not demonstrate the precise relief granted.

The July 2026 reinstatement brochure can help organize later steps, but the current statute and entered order control the case-specific restrictions. A conviction may add program completion, testing, insurance, and other conditions after the administrative period. Indefinite or repeated-offense revocations also involve the distinct petition provisions of section 46.2-391. Do not treat expiration of the immediate action as completion of those later requirements.

Separate hearing costs from restoration obligations

Ask the court about the applicable filing process and any charges for the requested proceeding instead of applying DMV's restoration fee to a hearing request. DMV's published reinstatement fees concern the licensing orders requiring payment. Its online fee transaction warns that payment is only one step toward restoring privileges. A payment confirmation cannot establish that the court granted review, stayed the suspension, or issued restricted authority.

After a DUI-related conviction, the financial responsibility requirement can apply independently of the administrative review result. Commercial drivers likewise face separate commercial disqualification rules. Ordinary restricted driving does not permit operating a commercial motor vehicle. For a driver employed in transportation, evaluate the civilian license, commercial status, and court order separately before arranging a return to work.

Frequently Asked Questions

Where is a Virginia immediate DUI suspension reviewed?
The request goes to the general district court for the arrest jurisdiction or the appropriate court exercising juvenile jurisdiction, rather than a generic DMV hearing unit.

When may the administrative review be requested?
Section 46.2-391.2 permits a request during the suspension period and provides expedited consideration, making prompt contact with the proper court important.

Does this hearing decide whether the driver is guilty of DUI?
Administrative review concerns the statutory probable-cause grounds and suspension level, while the DUI charge proceeds separately.

Can the court reduce a repeat-offense administrative suspension?
The court can remove the portion exceeding a properly supported offense level when the statutory probable-cause showing warrants that result.

Is there a restricted option for a second-offense administrative suspension?
Current 2026 law provides a court petition route with interlock and certified program conditions for the specified second-offense administrative action.

Does return of the license card prove unrestricted eligibility?
The returned card does not resolve another active suspension, later conviction order, or separate commercial disqualification on the driver's record.
