Separate the incident into its licensing actions

Missouri calls the principal intoxicated-driving offense DWI. The Department of Revenue DWI overview distinguishes criminal proceedings from administrative licensing enforcement. A court can transmit a conviction that produces points, while an alcohol test or refusal can support a different licensing action. Reducing or disposing of a ticket does not automatically cancel the administrative case. Gather the court disposition and every DOR notice, then record the action type and dates from each. Treating the incident as one ticket with one completion date can leave a separate revocation or reinstatement requirement unresolved after the court matter appears finished.

Read the first-conviction suspension correctly

DOR describes a first DWI or excessive-BAC conviction as a ninety-day suspension. Qualifying drivers may obtain restricted privileges for part or all of that period through the alcohol-point RDP options. Eligibility does not mean that the original plastic license remains fully valid. One route involves thirty days without driving followed by a sixty-day restricted privilege; another can provide an immediate ninety-day interlock restriction when its conditions are met. Review the actual notice and request procedure before making work or school transportation plans. The allowed travel purposes differ between those options and are not equivalent to unrestricted personal use.

Examine the consequences of repeat convictions

A second intoxication-related traffic conviction normally brings a one-year point revocation even if many years separate the convictions. When a second qualifying offense falls within five years, a five-year license denial may also apply; three or more intoxication-related traffic convictions can produce a ten-year denial. Those are distinct categories in the state overview, not interchangeable estimates of a likely sentence. Use the official Missouri driver record to establish the history DOR is using. A prior matter's familiar nickname or an old attorney invoice does not establish how the enforcement contact appears in the licensing system.

Keep administrative alcohol enforcement on its own timeline

The administrative alcohol instructions concern test results at or above .08 percent, with a .020 percent threshold for covered minors. The administrative period depends on the relevant prior five-year record and can be a ninety-day suspension or one-year revocation. The right to request the DOR hearing has its own short deadline, separate from the criminal court date. Read the issued Notice of Suspension or Revocation immediately rather than waiting for a later plea or trial setting. When a hearing is requested and granted, the temporary privilege and decision notices govern what driving remains lawful during that process.

Recognize a chemical refusal as a different case

Missouri's chemical-revocation guidance describes a one-year revocation for refusing the requested alcohol or drug test. Review goes to the appropriate circuit court rather than through the ordinary administrative BAC hearing request. The statute governing that process is section 302.574. A refusal can have reinstatement consequences even without a DWI conviction, and a driver's decision to contest the criminal charge does not automatically resolve the refusal record. Keep the refusal notice apart from any BAC-test notice so an application, petition, or request for relief is sent through the route that actually applies.

Apply the August 2026 interlock expansion

The 2026 driver licensing changes expanded mandatory ignition interlock to specified first-time DUI convictions: a BAC of .15 or higher, or an offense involving property damage or personal injury. Consequently, a first-offense label alone no longer establishes that interlock is unnecessary. The current reinstatement chart incorporates those conditions alongside requirements based on repeat alcohol or drug enforcement contacts. Review the conviction details and the applicable effective date instead of relying on a pre-change checklist. If the record contains both a conviction and an administrative action, have DOR identify how the interlock conditions apply across them.

Understand what maintaining interlock involves

The DOR ignition interlock explanation covers installation, monthly service, monitoring, and the effect of violations or early removal. For the reinstatement requirement, the usual minimum period described by DOR is six months from reinstatement, with a clean final three-month monitoring period; violations can extend the obligation. A court may impose a longer requirement. A paid installation invoice proves that equipment was installed, not that the entire obligation is complete. Before removing the device, obtain the required completion or violation-free certification and verify its transmission. Drivers using more than one vehicle must consider the requirement for every vehicle they operate.

Complete the assigned SATOP route

The Department of Mental Health SATOP program starts with assessment and placement rather than a driver's independent choice of the shortest class. Completion of the assigned service and reporting of the result support reinstatement, but do not alone restore a license. Missouri provides comparable-program procedures for people completing qualifying services elsewhere. Keep assessment records, payment receipts, and the final completion evidence, especially if the provider later closes. Program costs are separate from the DOR reinstatement charge and from interlock or insurance expenses. Confirm that the program being purchased will meet the applicable Missouri completion requirements before enrolling.

Arrange insurance proof for the correct period

The alcohol reinstatement chart generally calls for an SR-22 filing maintained for two years from the beginning of the suspension or revocation. A first administrative suspension for a driver under twenty-one testing at the covered .020 percent level has a stated exception, so do not apply the insurance requirement indiscriminately. The certificate is an insurer's filing with DOR, not simply a replacement name for an insurance card. Check the action date and whether another open action requires proof independently. Selling a car or changing insurers does not by itself cancel an obligation attached to the driver's reinstatement record.

Choose the correct restricted-privilege application

An administrative alcohol suspension uses the administrative RDP instructions, while a conviction-based suspension uses the alcohol-point instructions. Both differ from the Limited Driving Privilege process used for other qualifying circumstances. An active five- or ten-year denial requires a court petition for an LDP rather than a DOR application. A requested privilege may be unavailable because of another open action even when the alcohol case alone appears eligible. List employment, education, treatment, and other requested travel accurately, then rely on the purposes actually authorized in the issued document rather than on a general description of hardship licensing.

Check commercial driving independently

For a CDL holder, the Missouri commercial enforcement provisions can impose disqualification separate from the ordinary license action. DOR identifies a one-year commercial disqualification for a qualifying CMV conviction involving an alcohol concentration of .04 percent or higher. Other qualifying alcohol events may affect a commercial privilege even when the vehicle involved was a personal car. A restricted or limited noncommercial privilege does not permit continued commercial driving. Before accepting a commercial assignment after an alcohol case, verify the CDL record as well as any base-license restoration; the two statuses can reach eligibility on different conditions or dates.

Close the case administratively before returning unrestricted

As reviewed October 21, 2026, DOR's chart lists a $45 reinstatement fee for the principal alcohol categories, with additional charges possible for separate actions. Use MyDMV or the specified central-office payment method and confirm receipt of required program, insurance, and interlock evidence. Full examinations may be required after a revocation, and an expired credential can create an additional issuance step. Obtain a clear statement of current eligibility from the Driver License Bureau when the record contains overlapping actions. Keep final confirmations together so a court completion order is not mistaken for DOR's completed restoration.

Frequently asked questions

Does a Missouri DWI dismissal automatically remove an administrative alcohol action?
Criminal disposition and administrative licensing enforcement are separate, so dismissal alone does not establish that DOR canceled the action.

Can a first Missouri DWI conviction still require ignition interlock in 2026?
The August 2026 changes cover specified first convictions involving BAC of at least .15, property damage, or personal injury.

Are Missouri's ninety-day and sixty-day restricted privileges identical?
They have different entry conditions and permitted travel purposes; the immediate ninety-day route includes interlock requirements.

Does SATOP completion replace the DOR reinstatement payment?
Program completion and the reinstatement fee are separate requirements, and insurance or interlock evidence may also be necessary.

Where does a driver with an active ten-year denial seek an LDP?
DOR directs those applicants to petition the circuit court rather than submit the ordinary departmental LDP application.

Does restored noncommercial driving mean a Missouri CDL disqualification is over?
Commercial eligibility must be checked independently because a base-license restoration does not necessarily clear the CDL action.
