Adding a lien
The TxDMV's lien page sends lien work to the county tax office, where the title fee of $28 or $33 by county is paid at application. To add a lien: the vehicle title and a completed Application for Texas Title and/or Registration (Form 130-U). To add another lienholder: the title, Form 130-U and an Additional Lien Statement (VTR-267). When a lien is recorded, the lienholder receives the new title, as the TxDMV notes on its title processing page.
The release after payoff
After the lien is paid off, the lienholder has 10 days from receipt of payment to release it. When the lien was recorded on a paper title, the lienholder mails the title to the owner. When it was recorded electronically, the title record stays with the TxDMV and the lienholder notifies the owner that the lien is removed; on receiving the electronic release the TxDMV converts the e-title to a paper title automatically and mails it to the recorded owner or a third party. The TxDMV's forms page carries the Prescribed Form for Release of Lien (VTR-266).
Removing a released lien from a paper title
Take to the county tax office the vehicle title, a release of lien letter or other notification from every lienholder currently named on the title, and a completed Form 130-U, with the TxDMV's instructions for the form (VTR-130-UIF). For an electronic lien no action is required of the owner.
Liens on replacement, bonded and disputed titles
A certified copy of a title with a lien recorded is applied for by the lienholder, or by the owner with an original release of lien (a fax or photocopy is refused), and a lien paid off but still recorded takes the same original release, as the replacement title guide explains. A bonded title issues on a vehicle with a lien less than 10 years old only with an original release or a letter of no interest from the lienholder; the TxDMV says an applicant who cannot get one is not eligible and may seek a court order from a county or district court awarding ownership free and clear of liens, with the order naming the owner, the make, model and VIN, and not naming the TxDMV. A lienholder who receives a Notice of Determination for a Bonded Title may file suit against the applicant and ask the TxDMV for a hold on the title, as the title guide sets out. Lien foreclosure forms for mechanics, storage facilities, landlords, self-service storage and vehicle storage facilities (the VTR-265 series) are on the TxDMV's forms page, and a repossessed vehicle is transferred with the Repossessed Motor Vehicle Affidavit (VTR-264).
Questions about liens
How is a lien added to a Texas title?
At the county tax office with the vehicle title and Form 130-U, for the title fee of $28 or $33 depending on the county; a second lienholder is added with the Additional Lien Statement (VTR-267) as well.
How long does the lender have to release the lien after payoff?
Ten days after receiving payment. On a paper title the lienholder mails the title to the owner; on an electronic title the lienholder notifies the owner and the TxDMV, which converts the record to a paper title automatically and mails it.
Do I have to do anything for an electronic lien?
No. The TxDMV says the lienholder coordinates the removal with it and no action is required by the owner, who receives the paper title in the mail.
A paid-off lien still shows on my title.
Submit the title, the release of lien letter or other notification from each lienholder named on the title, and Form 130-U at the county tax office. A replacement title with a lien still recorded needs an original release of lien; a fax or a photocopy is not accepted.
Can I get a bonded title on a vehicle with a lien?
Only with an original release of lien or a letter of no interest from each lienholder whose lien is less than 10 years old; without one, the applicant may seek a court order awarding ownership free and clear of liens, without naming the TxDMV.
Is there a prescribed release form?
Yes, the Prescribed Form for Release of Lien (VTR-266) on the TxDMV's forms page, alongside the foreclosure forms for mechanic's, storage, landlord's, self-service storage facility and vehicle storage facility liens.
