Frequently Asked Questions
Are Mississippi marriage records public?▼
Marriage records in Mississippi are generally public — anyone can verify that a marriage occurred and request a non-certified copy. Certified copies (needed for legal purposes like name changes or immigration) may be restricted to the spouses, immediate family, or those with a court order.
How long does an arrest stay on my record in Mississippi if I wasn't convicted?▼
In Mississippi, an arrest stays on your record indefinitely unless you petition the court to seal or expunge it, even if charges were dropped or you were found not guilty. Mississippi's rules for clearing non-conviction records are stricter than for convictions — start with the Mississippi Department of Public Safety – Criminal Information Center.
What's the difference between a court record and a criminal record in Mississippi?▼
A court record shows everything filed in a specific case — pleadings, motions, judgments. A criminal record (rap sheet) is a person-centric history from the Mississippi Department of Public Safety – Criminal Information Center that aggregates arrests and dispositions across all courts in Mississippi. Court records are searched by case; criminal records by person.
What's the difference between a bench warrant and an arrest warrant in Mississippi?▼
An arrest warrant is issued by a judge based on probable cause that a crime was committed. A bench warrant is issued when someone fails to appear in court or violates a court order. Both authorize police to take you into custody in Mississippi — bench warrants are far more common in traffic and minor cases.
